Portrait Rights - Terms & Conditions

The Depicted Person is recognizably depicted in photographs and/or video’s taken for the promotion of Loop’s products and/or services (the "Content") and:

Declares that the Content was made with the express consent of the Depicted Person;
Hereby grants to Loop the right (which right may be transferred to third parties at Loop’s sole discretion) to use, publish, reproduce and/or distribute the Content without restriction;
Declares that he/she is aware of the rules regarding portrait rights (as can be found, inter alia, at https://overheid.vlaanderen.be/communicatie-portretrecht);
Hereby declares that it completely and definitively renounces any claims to any right, title or interest with regard to the Content and/or parts thereof and, as far as possible under the applicable legislation, transfers such right, title or interest to Loop. The waiver applies to the publication on all online and offline marketing channels (including paid media and organic social media channels), magazines and newspapers or other printed matter of images as well as to the use on websites, pitchdecks, or other marketing materials;
Declares to receive a pair of Loop Experience earplugs in consideration for the rights granted to Loop herein;
Confirms that all copyrights or other intellectual property rights in the Content belong to the Loop; and
Declares that the Depicted Person shall indemnify Loop against any claim(s) to the portrait rights by or from the Depicted Person or the Depicted Person's legal representative (including the Depicted Person’s heirs, executors, administrators or successors in title).
